3 people own a property as Joint Tenants. One partner states in her will that her share will go to a cousin. What happens when she passes?
The Right of Survivorship prevails over the will. This is the same for Joint Tenants and Tenancy by the Entireties. Even though the will states otherwise, because of the estate (tenancy) chosen, this partner’s share of the property will go to the other surviving Joint Tenants.
